    The seminar will consist of a power point presentation that describes the investigation process.  The investigator will discuss in great detail why an employer is investigated, records that need to be kept and presented to the Department of Labor, and give examples of questions asked of employees during the interviews.  The investigator will discuss the fact-finding process and give an estimate of how long an investigation lasts. The presentation will also discuss the final conference and what assurances are needed from the employer.   The investigator will discuss the agency’s process of assessing of back wages, civil money penalties, liquated damages, and payment plans.

    Investigator Gilberto Herrera has worked with the Department of Labor 15 years. Mr. Herrera has conducted many compliance reviews of companies during his time as an investigator. The compliance reviews, Mr. Herrera has performed, have involved all the Acts the Department of Labor administers i.e. Fair Labor and Standards Act, Child Labor Act, Davis Bacon and Related acts, Service Contract Act, Family medical Leave Acts, and H-VISAs. Besides conducting compliance reviews, Mr. Herrera has assisted different regions throughout the country in training of new investigators, mentoring, assisting investigators that require a Spanish speaker, and performed outreach.

    Sara Zorich is a partner at Smith Amundsen.  She is an employment attorney handling immigration workplace enforcement, wage and hour issues and discrimination issues for her clients. Sara routinely works with clients on needs relating to I-9 audits, I-9 and E-Verify compliance, workplace enforcement counseling, defense of governmental immigration related audits and defense of discrimination claims relating to immigration status. Additionally, she handles matters relating to employment discrimination, retaliation claims, employment related tort actions, governmental wage and hour audits, wage and hour single Plaintiff claims and class action claims.
